Sample Contract from Kettle Hill

All puppies are sold with an AKC Limited Non-Breeding Registration unless purchased as a show prospect.  This means you cannot breed and register a litter and the dog cannot be shown in the breed ring.  You CAN participate in obedience, agility and all working events.  If at a later date, you decide you want to show your Newfoundland, the registration can be changed by me pending my evaluation of the puppy. 

Your Newfoundland puppy has been thoroughly examined by a veterinarian prior to your purchase and has currently been found to be healthy and capable of being a good companion.  Puppy has received all prophylactic immunizations, deworming and medical care needed at present.  A health record has been included. 

Your puppy’s heart has been carefully examined by a cardiologist and no sign of congenital heart disease is present at this time.  The signed, cardiologist form is included. 

Please take your puppy to your veterinarian within 72 hours for an examination at buyer’s expense.  If your puppy is found to be in ill health or not as represented during this exam and written documentation by your veterinarian is presented to me within ten days; you may return your puppy and AKC registration papers for a full refund or replace with the next available puppy or mutually agreeable Newfoundland. 

Your Newfoundland is guaranteed for a period of eighteen months against crippling hip/elbow dysplasia or any other crippling disease.  I have attempted to breed sound animals with sound ancestors.  However, I cannot guarantee radiographic perfection, but he/she should be functionally sound.  Determination of what constitutes a hereditary defect is to be by the unanimous agreement of two (2) veterinarians agreeable to both parties.  One of these veterinarians is to be Board Certified in the applicable specialty.  Costs of the opinions are to be assumed by the buyer.  In the event that your Newfoundland acquires any crippling defect despite our precautions and your good care, you may (but don’t have to) return your living Newfoundland and AKC registration papers for a full refund of your purchase price or replace with the next available like prospect or mutually agreeable Newfoundland.

Buyer agrees to annual veterinary checkups, including heartworm tests; to keep all immunizations current according to AVMA guidelines, to properly administer heartworm preventative and to provide all needed veterinary care.

Buyer agrees to provide his/her Newfoundland with a safe environment (fenced yard or kennel run with proper protection and shade).  A Newfoundland MUST NEVER BE LEFT TIED OR CHAINED IN THE YARD.  Buyer agrees to keep his/her Newfoundland off slippery surfaces and floors as he/she could easily injure growing joints; to not let small children pick up or sit or ride on a Newfoundland.  Buyer agrees to feed him/her a good quality ADULT food, to have fresh water available at all times and to keep your growing puppy thin since extra weight stresses growing joints.  A three month old puppy will usually weigh between 25-35 pounds.  From then on until about one year they will gain an average of 10 pounds per month.  Do not let him/her exceed this weight range.

Breeder’s kennel name, KETTLE HILL will be used as a prefix in naming your Newfoundland on the AKC registration application.  Buyer agrees to submit AKC registration application prior to expiration date or give to Breeder to submit.

Buyer agrees to notify Breeder if this Newfoundland is ever for sale or Buyer can no longer keep him/her.  Breeder has first right of refusal of purchasing the dog back at no more than the original purchase price and less if Newfoundland is not in good condition or properly groomed.  If Breeder is unable to buy Newfoundland back, Breeder will be able to assist in finding a good home.
